Happy Thanksgiving from George F. Martin and George B. Martin

We have much to be thankful for this year. We're thankful for the trust our clients put in us and the opportunity we are given to work toward their recovery. We're also thankful that several of our clients have made significant recoveries this past year and are leading lives with less pain and more freedom.

Finally, we're thankful that we live in a country where a single injured individual can take on some of the largest and most powerful entities in the world as an equal in a court of law....

The Next Generation of Slip and Fall Accident Prevention

Some people believe that personal injury lawyers would like to see more accidents because more injured people in the world means more income-potential for attorneys specializing in accidents. This view of the economics of personaly injury practice is flawed, of course. But, more importantly, after working with seriously injured people, it's painfully obvious why it breaks our hearts to see more people experience these kinds of injuries. Most personal injury attorneys want to see people receiv...

How often do lawyers misquote cases and statutes?

From Brandon Martin:

I treasure the memory of my first law and motion appearence as a young attorney because it reminds me of a lost innocence that I cannot imagine being capable of today. That's a good thing for my clients and I, of course, because it means I understand more and more that law must be seen as something that reflects the human beings who implement it with all of their susceptibility to flaws, failings, and ethical compromises. TBut, I miss the way I felt about the law when I...

Texting and Technology: When Will Phones Get Smart About Safety

A couple of years ago, Gary Klassen, the creator of BlackBerry Messsenger (BBM), told an audience at South by Southwest that he felt it was the responsibility of those who helped create the mobile messaging and texting revolution to create technology that would help prevent future harm from texting while driving. More than one personal injury lawyer has taken aim at Apple under a similar theory of duty, but the courts have been reluctant to agree. Klassen talked a bit about transparent dashbo...

Fixing the Streets of Bakersfield

Risk Management guru John Pryor contributed a very worthy "community voice" editorial to the Bakersfield Californian a few weeks ago. It had an immediate positive impact, but we'd also like to pass along some of Mr. Pryor's commentary here.

The editorial reveals a tragic uptick in the number of pedestrian accidents occuring within the City of Bakersfield during 2017. According to Mr. Pryor:

We can consider how Bakersfield compares with other cities. Benchmarking tells us lots about how...

Indicators of Concussion to Look for After a Car Accident

It's not uncommon for people who have sustained a head injury or concussion in a car accident to immediately tell those around them something along the lines of "I'm not injured" or "Whew, I'm okay!" Yet hours or days later, they feel the effects of a sudden jolt shaking the brain that they were previously oblivious to. One of the possible explanations for this phenomenon is the adrenaline released during the extremely intense stress experienced during a car accident. But regardless of the deb...

National Teen Driver Safety Week: Too Many Teens Are Dying on Our Roads

Here are a couple of sobering facts to commemmerate National Teen Driver Safety Week, which will fall on October 15th through October 21st this year:

  • Auto accidents are the leading cause of death for teens from 15 to 18 years old in the United States of America. This places them ahead of death caused by any other type of injury, disease, or violence.

  • Approximately 99,000 teenage drivers were injured in auto accidents every year.

There isn't really good news about the endlessly sad subj...
